The justices determined the “plaintiffs lack standing to challenge the FDA’s actions“ on expanding access to mifepristone.
The Supreme Court released its unanimous decision that doctors’ groups lacked the legal grounds to sue the Food and Drug Administration’s (FDA) approval of the abortion drug mifepristone.
Justice Brett Kavanaugh wrote the unanimous decision, stating, “Plaintiffs are pro-life, oppose elective abortion, and have sincere legal, moral, ideological, and policy objections to mifepristone being prescribed and used by others. Because plaintiffs do not prescribe or use mifepristone, plaintiffs are unregulated parties who seek to challenge FDA’s regulation of others.”
Justice Kavanaugh wrote, “Citizens and doctors who object to what the law allows others to do may always take their concerns to the Executive and Legislative Branches and seek greater regulatory or legislative restrictions on certain activities.”
Justice Clarence Thomas stated, “The party who needs the remedy—the injured member—is not before the court.”
As the Lord Leads, Pray with Us…
- For discernment for the Supreme Court justices as they release decisions in the remainder of the cases outstanding in next two weeks.
- For U.S. health care officials to be realistic as they assess the risks and dangers of the abortion drug to women’s health and wellbeing.
- For the Lord to touch the hearts of Americans to value the sanctity of unborn human life.
